Jamaican Green Card Holders Urged to Stay Vigilant Amid US Immigration Crackdown
Jamaican holders of American green cards are being warned to remain vigilant and adhere strictly to the requirements for maintaining their legal status when traveling outside the United States.
This caution comes from Jamaican immigration attorneys and advocates in light of increased immigration enforcement efforts under President Donald Trump, who recently returned to the White House. Reports have surfaced of green card holders being questioned upon re-entry and, in some cases, being asked to sign Form I-407—an official Record of Abandonment of Lawful Permanent Resident Status.
Know Your Rights: Don’t Sign Away Your Status
Immigration attorneys are urging Jamaicans accused of violating travel rules not to sign any forms presented to them at US ports of entry. Instead, they should request a hearing before an immigration judge who will assess whether a violation has actually occurred.
Attorney Wayne Golding emphasized the importance of staying informed, warning that misinformation is spreading rapidly. He advised green card holders to return to the US well before the one-year travel limit expires to avoid complications.
“There is a lot of fear-mongering happening, often from individuals with no legal expertise who are simply trying to gain business,” Golding told The Gleaner.
Golding further explained that immigration officers have the authority to question returning green card holders if they suspect an extended absence. However, travelers with legitimate reasons for exceeding their permitted stay can present their case before an immigration judge rather than signing away their status.
Re-Entry Permits: A Crucial Step for Extended Travel
For green card holders needing to stay outside the US for longer than a year, Golding stressed the importance of applying for a re-entry permit before departure. This permit allows individuals to remain outside the US for up to two years without jeopardizing their permanent resident status.
Stay Informed and Seek Legal Advice
Immigration attorney Winston Tucker echoed Golding’s sentiments, advising green card holders to stay informed about the rules governing their status.
“If you have any doubts, consult a reputable immigration attorney before leaving the US,” he cautioned.
Tucker reiterated that no one should sign an I-407 form without first seeking legal counsel and, if necessary, requesting a hearing with an immigration judge. He also noted that due to heightened immigration scrutiny, green card holders should be extra cautious and aware of their rights.
Consider Citizenship to Avoid Hassles
To further safeguard against immigration issues, Tucker encouraged eligible green card holders to apply for US citizenship, which would eliminate the risks associated with prolonged travel outside the country.
Irwin Clare, head of Queens-based Caribbean Immigration Services, reinforced the importance of compliance with travel regulations, stating, “In this heightened immigration atmosphere, it’s crucial for everyone to understand the rules and the consequences of violating them.”
